For more than two months now we have been cooperating with Arizona authorities to help determine the cause of the tragic Sedona sweat lodge accident. We have worked to facilitate interviews involving the James Ray International employees and the authorities, and my representatives have also conducted a large number of interviews and collected a great deal of other information on their own. As this work continues now into the New Year, I believe it is time to share with you the information – two White Papers, along with supporting materials -- that my representatives have shared with Arizona authorities.

UPDATE from Cassandra Yorgey: things that make you go hmmmmm.
"They closed the flap starting the 7th round. It was then someone said, ‘she's not breathing; I can't get her to move’. James Ray said, ‘doors down; we will deal with it later’. Someone said, ‘I can't take it, I am hurting’. James Ray then told them to quiet down he said, ‘I'm the one talking now’. Everyone seemed to quiet and Beverly said she was concentrating on getting through. The door came open and James Ray invited everyone who had left to come back in for the last round."
"Beverly said she tried to get up and was told to sit back down. That was when she looked at Sydney [Spencer] who was still unconscious. Beverly said Sydney's eyes were rolled back in her head and she had drainage coming from her mouth and nose and was barely breathing."
A participant who was at the hottest part of the death lodge reports the following:
"After Sidney [Spencer] was taken out, James (Shore) came back in and took that spot so now it is James and Kirby (Brown) to her left. They went another round and someone said something about Kirby, she believes it was James (Shore). The participant said they decided to roll her over because she was on her back and gurgling. She said it was awful like there was fluid in her breathing, like a snotty nose and gurgling and she said it was alarming. She would not respond to roll over and James went to the other side of her trying to turn her. The participant said she took her feet while still trying to stay flat to get her up so she was no longer on her back. James was pulling on her arms and talking to her all the while she continued to gurgle. The participant said she and James were face down trying to get this done. She said the next time she saw Kirby she was now laying on her side and James was facing towards her up on his arm coaching her along and talking to her. She said at one time James opened the back so there was light, trying to get air. She said it was requested that he close it. She said he asked that Kirby needed to come out. The participant said at that point James Ray said nobody else can leave at this time."
"The participant remembers thinking James (Shore) was so incredible helping Kirby. She said James Shore did ask to have Kirby moved. She said James (Shore) just put it out there (the statement that Kirby needed assistance) in a matter of fact tone. She said it was late in the process and they were pretty weak. She thinks James Shore said, we need help over here. She believes James Ray said the ceremony was going to continue, that no one else can leave at this point we have to close the gate. She said the gate was open when she (Kirby) was having this problem. I asked if everyone else could see Kirby and she said she didn't know because Kirby was a person away from her."
This is where I fell asleep at my keyboard last night, sobbing over the loss of two people I will never have the chance to meet. All accounts indicate that James Shore knew exactly how dangerous it was to go back into the death lodge, but he did it anyway to try and save Kirby Brown. James Shore died a hero’s death while James Ray, one of the only able-bodied people left, didn’t lift a finger. James Shore was alive and talking right up until the end of the last round. He probably would have survived if he and Kirby hadn’t been left in the death lodge.
James Arthur Ray emails Widow Just in Time for the Holidays!
On Christmas Eve, I went to visit my second earthly mother, Jane, in order to drop off James and Alyssa's eldest daughter's Christmas present (James Shore's lap top - which returned from Arizona without its owner). I stayed to visit with Jane - a wonderful and loving mother - an unrelenting advocate for her children - a mother who has twice had to bury one of her sons. She was stoic, per usual... but this didn't fool me. I have known Jane for years. While I wrote down the password for the computer, Jane was looking at a photo of James and Alyssa which she had pulled from the center of the fireplace mantle. I took note and drew a deep breath... Then she said, "He can never be replaced." I replied, "I know it." I exhaled slowly and affixed the sticky note to the machine's screen and closed the lap top that was once held in the loving hands of my brother James - to send it, gift wrapped, to his eldest daughter. That I was sending forth a relic - a cold, calculating-machine to his first child - in the guise of something she might want for Christmas was almost laughable. Who will embrace these children as their father?
James' youngest - his son, D, fell fast asleep knowing that in the morning he would know the truth of Santa Claus... He told Alyssa that if Santa was real, he would surely bring his father back (especially given how well-behaved he's been these past couple months.) He tucked himself in early, so excited was he that his father would be returned to him when he awoke. Who will give him his childhood back? Who will take him to the skate park, the movies, read to him the exploits of Frodo and Gandalf, and teach him about being a man? Who will see him off when the time comes for him to make his own way? Who will counsel him - as flesh-of-flesh, blood-of-blood?
Jane is right: he can never be replaced.

I just wanted to send out a quick message during this season to remind you to take time from all the typical rush to keep in mind the true value of what the holidays represent; to connect with your family; to count the many blessings you have in your life; to celebrate all your accomplishments for the year, whether great or small; to remember all the wonderful lessons you've learned, even if they came disguised as challenges; and to maybe most importantly take some time for yourself and reflect upon your dreams, intentions and values for the new year.

UPDATE: when negligence becomes something much worse...
According to documents, a man who helped build the lodge told investigators he helped with the ceremonies three times, and every time people would end up in medical distress. He also said Ray ignored the problems.
James Shore, the "Heretic" - Dies on a "Good Day to Die"
During the sweat lodge, Beverley remembers hearing someone say, "I can't get her to move, I can't get her to wake up." James Ray replied, "Leave her alone, she'll be dealt with in the next round." This confirms the statements made by the Mercers. At one point, someone lifted up the side of the tent to get air. James reprimanded the person and said this was "sacrilegious". We determined through other interviews that the person lifting up the tarp to get air was one of the victims, James Shore. Beverley also stated that James Ray was saying things like, "You may think that you're going to die but you're not going to die." This further confirms the Mercer's statements.
